Parents Sue Milford Police Over Death of Son

Son was killed by police car.

Frank and Susan Servin of Orange have filed a civil lawsuit against the City of Milford and three individuals in the over the death of their 19-year-old son David Servin, who was killed, along with his girlfriend, Ashlie Krakowski, 19, in a .

Milford patrol officer Jason Anderson was returning to Milford after assisting in a call in West Haven. He was reportedly driving 94 mph on the Boston Post Road in Orange when he slammed into the side of the teen’s car as they turned onto Dogwood Road near the .

Anderson pleaded not guilty to second-degree manslaughter charges and the case has yet to go to trial.

In the lawsuit, filed March 17, the Servin family named Anderson and Milford officer Richard Pisani, who was following Anderson from the West Haven incident and caught the crash on his cruiser’s dash camera. Also included is Police Chief Keith Mello, who oversees the department, and the City of Milford, which owns the police cruiser involved in the crash.

Among the claims in the suit:

"Anderson failed to warn the plaintiff (David Servin) of his approach, by horn, flashing lights, or any other means or take any other reasonable precaution to avoid injury to David Servin."

Claims against Pisani include:

"He observed Anderson overtake and pass him illegally on the right, at a high rate of speed at least twice the speed limit and he failed to take any police action to arrest or atop Anderson, or contact Anderson by use of his radio, telephone or computer to stop this dangerous activity."

The family is represented by the Law Offices of R. Bartley Halloran of Farmington.

A spokesman for the Milford Police Department, Officer Jeffrey Nielsen, said police were unable to comment on the matter due to pending litigation.
